Act 13 requires an employee or administrator who has reasonable cause to suspect that a recipient is a victim of abuse to immediately report the abuse to the Area Agency on Aging. Abuse is defined as the occurrence of one or more of the following acts: the infliction of injury, unreasonable confinement, intimidation or punishment with resulting physical harm, pain, or mental anguish; the willful deprivation by a caretaker of goods or services which are necessary to maintain physical or mental health; sexual harassment; sexual abuse which is knowingly or recklessly causing rape, involuntary deviate sexual intercourse, sexual assault, statutory sexual assault, aggravated indecent assault or incest. All of these acts are fully explained in the 5-page Act 13. Instructions for completing Act 13 Mandatory Abuse Report Form are also included.
